Terms of Service

Welcome to Hairqut.com (the “Site”), operated by Hairqut Inc. (“Hairqut”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, including any features, content, functionality and services offered on or through the Site and our mobile hair/barber services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with all of these Terms, then you may not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this eligibility requirement and have legal capacity to enter into these Terms.

2. Description of Services

Hairqut connects clients (“Clients”, “you”) with independent mobile hairdressers and barbers (“Service Providers”) who travel to the location you select (home, office, retirement residence, event venue or other approved site) to deliver hair-cutting, styling, grooming or related mobile services (“Mobile Services”).
The Site also provides booking tools, profiles, scheduling, payment processing and communications features. We reserve the right to modify or discontinue any aspect of the Services at any time.

3. Service Location Conditions & Client Responsibilities

You agree to select a service location that is safe, hygienic and suitable for the mobile service, including adequate lighting, access to a power outlet, a stable chair or surface, sufficient space and a clear work-area for the Service Provider.

If the location is deemed unsafe or unsuitable by the Service Provider, we may reschedule or cancel the appointment without refund.

You must disclose prior to the appointment any known allergies, scalp/skin sensitivities, medications, recent treatments, infections or conditions that may affect the service outcome. Failure to disclose may impact results and you accept the associated risks.

You agree to follow any after-care instructions provided by the Service Provider.

4. Booking, Payments, Travel & Additional Fees

Bookings are confirmed only once payment (or deposit, if required) has been successfully processed.

Travel, off-hours or remote location fees may apply and will be disclosed at booking. Additional charges may apply if the service site causes delay, additional time or extra travel.

Any requested changes to booking (date/time/location) must follow the cancellation or reschedule policy communicated at booking.

5. Cancellation, No-Show & Rescheduling

Cancellation with fewer than [insert number] hours’ notice (or as otherwise stated) may incur a cancellation fee of [insert %].

No-show or failure to attend the appointment without notice may require payment of the full service fee.

Refunds or credits are subject to the policy provided at booking and applicable consumer protection laws.

6. Results, Risks & Waiver of Liability

Mobile hair & grooming services inherently involve risks including but not limited to hair breakage, scalp irritation, allergic reactions, uneven results, or variation due to hair type, prior treatments or mobile service conditions.

No guarantee of a specific result is given; we commit only to use professional skill and standard of care.

To the fullest extent permitted by applicable law, you release Hairqut Inc., its officers, directors, employees, agents and the Service Providers from any claim, liability or cost arising out of or related to the Services — except in the case of gross negligence or willful misconduct.

Our total liability for any claim related to these Terms or Services shall not exceed the total amount you paid for the service in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential or punitive damages.

7. Service Refusal & Termination on-Site

We reserve the right to refuse, suspend or terminate the Service if:

The location is unsafe, unhygienic or does not meet the required conditions.

You provide false or incomplete information, fail to disclose conditions or act abusively or uncooperatively.

The Service Provider determines in their reasonable discretion that continuing would be unsafe or unwise.

In such cases, refund or rescheduling is at our discretion and subject to the communicated policy.

8. Intellectual Property

The Site, its features, content and functionality (excluding User Content) are the property of Hairqut Inc. and are protected by applicable copyright, trademark and other intellectual property laws.

You are granted a limited, non-exclusive, revocable license to access and use the Services for personal, non-commercial purposes.

You may not reproduce, distribute, create derivative works, publicly display, or otherwise exploit any part of the Site without our prior written permission.

User Content

If you submit, post or display any content (photos, reviews, feedback, comments) (“User Content”), it is done on a non-confidential, irrevocable basis. You grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, distribute and display your User Content in connection with the Services.

You warrant that your User Content does not infringe any third-party rights and complies with these Terms.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

10. Independent Service Providers

You acknowledge that Service Providers are independent professionals, and Hairqut Inc. acts only as a platform connecting you with them. We do not guarantee the quality, safety or result of any provided service.

11. Dispute Resolution; Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. The exclusive jurisdiction for any disputes will be the courts located in Montreal, Quebec. You and Hairqut Inc. waive any right to a jury trial and agree to resolve claims individually and not as a class.

12. Changes to Terms

We may update or amend these Terms at any time by posting the revised Terms on the Site with a new Effective Date. Your continued use of the Services after changes indicates your acceptance of the revised Terms.

13. Miscellaneous

These Terms constitute the entire agreement between you and Hairqut Inc. regarding the Services and supersede all prior or contemporaneous communications and proposals.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
